Deanna Tucker Successfully Defends Appeal of Summary Judgment – 2019
In February 2019, Deanna M. Marzian Tucker and Christine D. Campbell successfully defended the appeal of summary judgment entered in favor of their client by Jefferson Circuit Court. At issue was whether the trial court erred in granting summary judgment to a bowling alley where the plaintiff fell when crossing the foul line, and erred in denying the plaintiff’s Motion to Alter, Amend of Vacate the entry of summary judgment for the defendant. The Kentucky Court of Appeals affirmed both the summary judgment and the denial of the Motion to Alter, Amend or Vacate, finding that the plaintiff had not properly preserved her arguments for appeal. The Kentucky Supreme Court denied the plaintiff’s motion for discretionary review.
