Mike Maloney and Blake Edwards Successfully Defended a Construction Co. – 2016

In February 2016, Mike Maloney and Blake Edwards obtained Summary Judgment in United States District Court on behalf of a construction company that was sued following a construction site accident. The injured worker asserted negligence claims against a subcontractor who performed work on the construction project. The subcontractor, in turn, filed a third-party complaint against the construction company asserting claims for negligence, negligence per se, breach of contract, and indemnification. The Court held that the construction company was immune from liability under the Kentucky Workers’ Compensation Act. As a result, the Court dismissed all claims against the construction company.
